Welcome! We are Way.com. This Privacy Notice explains how Way.com, Inc., and its affiliates (collectively, "Way.com," "Company," "we," "us," or "our") collect, use, disclose, and otherwise process personal information (as defined below) in connection with our websites (the "Sites") and other websites we own and operate that link to this Privacy Notice, and the related content, platform, services, products, and other functionality offered on or through our services (collectively, the "Services"). It does not address our privacy practices relating to Way.com employees and other personnel.

Way.com is the controller of the personal information we hold about you in connection with your use of the Services. This means that we determine and are responsible for how your personal information is used.

This Privacy Notice does not cover any personal information that we may process on behalf of our customers (i.e., personal information submitted by our customers that allows us to provide the Services where the customer is generally the "data controller" of such personal information) ("Customer Data"). We typically receive Customer Data when our customers upload or send to us personal information related to third parties. For such Customer Data, we act as "processor" and have contractually committed ourselves to only process such Customer Data on behalf of and under the instruction of the respective customer. This Privacy Notice does not apply to such processing, and we recommend you read the privacy notice of the respective customer if their processing concerns your personal information.

INSURANCE USERS

We receive and store any information you knowingly provide to us. For example, through the registration process and/or through your account settings, we may collect Personal Information such as your name, email address, phone number, and third-party account credentials (for example, your log-in credentials for Facebook, your current insurer or other third party sites). If you provide your third-party account credentials to us or otherwise sign in to the Services through a third party site or service, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us if you authorize such transmissions, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy, for example, your list of friends or current insurance information may be accessed. Certain information may be required to register with us or to take advantage of some of our features. For example, you may fill out applications for insurance or other forms such through our website, email or paper correspondence, or otherwise. In addition, we may receive information directly from you or from third parties in connection with the insurance transactions with us. For example, we may obtain information regarding your insurance transactions from the insurance companies we contact to underwrite your insurance. We may also obtain information from governmental agencies (such as the Department of Motor Vehicles) and consumer reporting agencies. We may also receive information related to insurance claims from medical records and medical professionals. We will communicate with you by email, chat, or phone with respect to your insurance transactions with us. We may also communicate with you regarding topics other than your insurance transactions with us if you've provided us the means to do so. For example, if you've given us your email address, we may send you promotional email offers on behalf of other businesses, or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us by email or do not wish to receive communications other than with respect to your insurance transactions with us, please indicate your preference by sending an email to Support@way.com.

WEB COOKIES

A "web cookie" is a string of information that a website stores on a user's computer, and that the user's browser provides to the website each time the user submits a query to the site. way.com uses web cookies to track the pages that users visit during each website session, both to help way.com improve users' experiences and to help way.com understand how the website is being used. as with other non-personally-identifying information gathered from users of the website, way.com analyzes and discloses in aggregated form information gathered using web cookies, so as to help way.com, its partners and others better understand how the website is being used. way.com does not attempt to link information gathered using web cookies to personally-identifying information. way.com users who do not wish to have web cookies placed on their computers should set their browsers to refuse web cookies before accessing the website, with the understanding that certain features of the website may not function properly without the aid of web cookies. website users who refuse web cookies assume all responsibility for any resulting loss of functionality.

WEB BEACONS

A "Web Beacon" is an object that is embedded in a web page that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page or an email. Way.com may use Web Beacons on the Website and in emails to count users who have visited particular pages, viewed emails, and to deliver co-branded services. Web Beacons are not used to access users' Personally-Identifying Information; they are a technique Way.com may use to compile aggregated statistics about Website usage. Web Beacons collect only a limited set of information including a Web Cookie number, time and date of a page or email view, and a description of the page or email on which the Web Beacon resides. You may not decline Web Beacons, however, they can be rendered ineffective by declining all Web Cookies or modifying your browser setting to notify you each time a Web Cookie is tendered and permit you to accept or decline Web Cookies on an individual basis.

When we use the term "personal information" in this Privacy Notice, we mean any data or information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular natural person or household or any other data or information that constitutes "personal data," "personal information," or "personally identifiable information."

  2. We collect personal information in a variety of ways. For example, you may provide us your personal information when you place an order, register for an account or loyalty membership, make an online purchase, post a review, send us messages, subscribe to our mailing lists, newsletters, or other forms of marketing communications, submit a job application, participate in a survey, contest or sweepstakes, redeem a promotion, or use some other feature of our Service.We may link or combine your activities and information collected from you on our websites and mobile apps with information we receive from third parties, as well as information we collect automatically through tracking technologies (defined below). This allows us to provide you with a personalized experience regardless of how you interact with us.

Personal Information Collected from You

We may collect the following categories of personal information submitted to us by individuals through the Services:

  • Contact Information, including first and last name, business and/or personal email address, physical address, job title, your area of responsibility, company name, phone number, your country or region, and communication preferences. We use this information to fulfill your request or transaction, to communicate with you directly, and to send you marketing communications in accordance with your preferences.
  • Account Information, including first and last name, company name, employer, job title, business and personal email address, user ID and password, date of birth, profile information, affiliations, account balances, and any other information you provide to us. We use this information to administer your account, provide you with the relevant service and information, communicate with you regarding your account and your use of the Service, and for customer support purposes.
  • Payment Information and Payment History, If you sign up for one of our Services requiring payment (i.e., subscription services, parking, carwash, and other related services), we collect the information provided in connection with such payment, including payment information and payment history. Please note that we use third-party payment processors, including through the Apple and Google Play stores and Stripe, to process credit card payments made to us. As such, we do not retain any of the full credit card numbers but may retain other card payment information other than full credit card numbers.   • Vehicle Information, Depending on the Services you request, we collect information about your vehicle, including license plate number and vehicle make, model, and year.
  • Inquiry and Communications Information, including information provided in custom messages sent through the forms, in chat messages, to one of our email addresses, or via phone. This also includes contact information provided on our Services. We use this information to investigate and respond to your inquiries, communicate with you, enhance the services we offer to our users, and to manage and grow our organization.
  • Marketing Emails and Blog Information, including email address and applicable interests and communication preferences. We use this information to manage our communications with you and send you information about products and services we think may be of interest to you. If you wish to stop receiving email messages from us, simply click the "unsubscribe link" provided at the bottom of the email communication. Note that you cannot unsubscribe from certain services-related email communications (e.g., account verification, confirmations of transactions, technical or legal notices).
  • Contest, Sweepstakes, and Survey Information, including information provided when you enter a contest or sweepstakes or information included in any questions submitted through surveys or content of any testimonials. We use this information to administer and facilitate the Services, to respond to your submission, to communicate with you, to conduct market research, to inform our marketing and advertising activities, and to improve and grow our business.
  • Event and Webcast Information, including registration information, call-in details, attendee badge information, and contact information. We use this information to administer and facilitate the Services and improve and grow our business.
  • Information Collected Through the Use of the Service, including any files, documents, videos, images, data, or information you choose to upload or transmit through your communications with us or your use of the Site (collectively, "User Content"). User Content and any information contained in the User Content, including personal information you may have included, is stored and collected as part of the Service. We use the User Content to provide you with the Service.
  • Events, Surveys, and Promotions. If you fill out any forms or participate in Way.com events, surveys, competitions (contests/sweepstakes), or other promotional events, we may collect your contact information (such as your name, email, phone number, postal code), your Demographic Information, and any other information requested on the form, at sign up, or a part of your competition entry, including photos/videos (each, as applicable). On occasion, we may also collect your shipping and billing information, such as if you are a competition winner or purchase our products or services (where available). If you are part of our event or promotion partner, we may also collect your personal information, including your name, company email, and company address.
  • Feedback Information. We may also collect feedback and ratings you provide relating to our services or products. We use this information to communicate with you, conduct market research, inform our marketing and advertising activities, and improve and grow our business.
  • Business Representative Contact Information. If you are a business representative, we collect your information in connection with the performance of the agreement or potential agreement with us. This information may include your first name, last name, company contact information (e.g., email, phone, address), job title, and any other information related to the performance of the agreement with us.
  • Employment Application Information, including your contact and demographic information, educational and work history, employment interests, information obtained during interviews, and any other information you choose to provide if you apply for employment.
  • Other Information that you provide to us online, by phone, or in person, and we use this information to respond to your request, provide you with the requested services and inform our marketing and advertising campaigns.

Personal Information from Third Parties

We also obtain personal information from third parties, which we often combine with personal information we collect either automatically or directly from an individual.

We may receive the same categories of personal information as described above from the following third parties:

  • Way.com Entities: We may receive personal information from other companies and brands owned or controlled by Way.com, and other companies owned by or under common ownership or control as Way.com. We receive this information to provide you with the services when you request additional services provided by our affiliates, or to improve your overall experience with the Services.
  • Your Employer / Company: If you interact with our Services through your employer or company, we may receive your information from your employer or company, including another representative of your employer or company. We use this information to operate, maintain, and provide to you with the features and functionality of the Service.
  • Other Users or Individuals who Interact with our Services: We may receive your information from other users or other individuals who interact with our Services. For example, if you engage directly with a vendor or other provider of services on our website, such as providing feedback or reviews, we may be able to see, or the vendor may share, that communication with us.
  • Social Media: When an individual interacts with our Services through various social media networks, such as when someone "Likes" us on Facebook or, follows us or shares our content, or makes posts on our social media pages on Google, Facebook, Twitter, or other social networks, we may receive some information about individuals that they permit the social network to share with third parties. The data we receive is dependent upon an individual's privacy settings with the social network and may include your profile information, profile picture, and any other information you make public or permit the social network to share with third parties. Individuals should always review and, if necessary, adjust their privacy settings on third-party websites and social media networks and services before sharing information and/or linking or connecting them to other services. We use this information to operate, maintain, and provide to you with the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.
  • Service Providers: Our service providers that perform services solely on our behalf, such as survey and marketing providers and payment processors, collect personal information and often share some or all of this information with us. The information may include contact information, demographic information, payment information, information about your communications and related activities, and information about your orders. We may use this information to administer and facilitate our services, your orders, and our marketing activities.
  • Business Partners: We may receive your information from our business partners, such as vendors companies, including parking garages and motor clubs, who offer their products and/or services directly on our Services. We may use this information to administer and facilitate our services, your orders, and our marketing activities.
  • Information we receive from authentication services you connect to our Service: Some parts of our Service may allow you to log in through a third-party social network or authentication service such as Facebook or Google. These services will authenticate your identity. The data we receive is dependent on that third party's policies and your privacy settings on that third-party site but will include a secure token to facilitate authentication. We use this information to operate, maintain, and provide to you with the features and functionality of the Service.
  • Other Sources:We may also collect Personal Information about individuals that we do not otherwise have from, for example, publicly available sources, third-party data providers, brand partnerships, or through transactions such as mergers and acquisitions. We use this information to operate, maintain, and provide to you with the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.

Through the provision of our Services, we may also process de-identified information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular consumer or household. Way.com commits to maintain and use the information in the de-identified form and will not attempt to reidentify the information, except in instances where necessary for determining whether the deidentification process used by Way.com satisfies the requirements under applicable law.

Personal Information Automatically Collected

We and our third-party partners automatically collect the information you provide to us and information about how you access and use the Services when you visit our services, read our emails, or otherwise engage with us. We typically collect this information through a variety of tracking technologies, including (i) cookies or small data files that are stored on an individual's computer and (ii) other related technologies, such as web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies and logging technologies (collectively, "tracking technologies") and we may use third-party partners or technologies to collect this information. Information we collect automatically about you may be combined with other personal information we collect directly from you or receive from other sources.

We, and our third-party partners, use tracking technologies to automatically collect usage and device information, such as:

  • Information on the computer, tablet, smartphone, or other device you use,such as your IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date, and time stamp, and a unique ID that allows us to uniquely identify your browser, mobile device, or your account (including, for example, a persistent device identifier or an Ad ID), and other such information. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which permit us to recognize and contact you across multiple devices.
  • Information about the way you access and use our services,for example, the site from which you came and the site to which you are going when you leave our services, how frequently you access the Service, whether you open emails or click the links contained in emails, whether you access the services from multiple devices, and other browsing behavior and actions you take on the Sites.
  • Information about how you use the Service, such as the pages you visit, the links you click, the ads you view and click on, videos you watch, and other similar actions. We may also use third-party tools to collect the information you provide to us or information about how you use the Service and may record your mouse movements, scrolling, clicks, and keystroke activity on the Service and other browsing, search or purchasing behavior. These tools may also record information you enter when you interact with our Service or engage in chat features through our Service.
  • Information about your location,such as general geographic location, that we or our third-party providers may derive from your IP address.
  • Analytics information.We may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for the services and to understand more about the demographics of our users. All of the information collected automatically through these tools allows us to improve your customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our Sites and Services, and to improve the effectiveness of our Service, offers, advertising, communications, and customer service. We may also use this information the data collected through tracking technologies to (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including targeted content and advertising; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our services; (e) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website; (f) diagnose or fix technology problems; and (g) otherwise to plan for and enhance our services.

Additional Uses of Personal Information

We may use the personal information we collect to:

  • Fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations, to deliver the Services you have requested, and to process transactions, including connecting you, through machine learning or other artificial intelligence algorithms, to requested parking, motor, and other services operated by our business partners or other vendors;
  • Manage our organization and its day-to-day operations;
  • Verify your identity and entitlement to products or Services when you contact us or access our Services;
  • Register you for and provide you access to events and webcasts;
  • Communicate with individuals, including via email, text message, social media, and/or telephone calls;
  • Request individuals to complete surveys about our organization, organizations we partner with, and Services;
  • For marketing and advertising purposes, including to market to you or offer you through email, phone, or text message information and updates on products or services we think that you may be interested in (where applicable, we may send you marketing messages if you have given us your consent to do so or where we have relied on the soft opt-in rule);

  • Process payment for our Services;
  • Facilitate customer benefits and services, including customer support through our command center services;
  • Identify and analyze how individuals use our Services;
  • Conduct research and analytics on our customer and user base and our Services;
  • Improve and customize our Services to address the needs and interests of our user base and other individuals we interact with;
  • Test, enhance, update, and monitor the Services or diagnose or fix technology problems;
  • Help maintain the safety, security, and integrity of our property and Services, technology assets, and business;
  • To enforce our Terms of Use, to resolve disputes, to carry out our obligations and enforce our rights, and to protect our business interests and the interests and rights of third parties;

  • For any other lawful purpose or other purpose that you consent to.

Where you choose to contact us, we may need additional information to fulfill the request or respond to inquiries. We may provide you with additional privacy-related information where the scope of the inquiry/request and/or personal information we require fall outside the scope of this Privacy Notice. In that case, the additional privacy notice will govern how we may process the information provided at that time.

  • Way.com Entities: We may share personal information with other companies owned or controlled by Way.com and other companies owned by or under common ownership as Way.com, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns, particularly when we collaborate in providing the Services.
  • Your Employer / Company: If you interact with our Services through your employer or company, we may disclose your information to your employer or company, including another representative of your employer or company.
  • Marketing Providers: We coordinate and share personal information with our marketing providers in order to communicate with individuals about the Services we make available.
  • Customer Service and Communication Providers: We share personal information with third parties who assist us in providing our customer services and facilitating our communications with individuals who submit inquiries.
  • Other Service Providers: In addition to the third parties identified above, we engage other third-party service providers that perform business or operational services for us or on our behalf, such as website hosting, infrastructure provisioning, IT services, chat communications providers, analytics services, employment application-related services, payment processing services, and administrative services.
  • Other Users: If you participate in any of our online communities or purchase goods or services on our Services, we may disclose your public profile information to other online community members, as well as any other information you choose to provide or make public.
  • Contests, Sweepstakes, and Survey Providers: We share personal information with third parties who assist us in delivering our contests, sweepstakes, or survey offerings and processing the responses.
  • Ad Networks and Advertising Partners: We work with third-party ad networks and advertising partners to deliver advertising and personalized content on our Services, on other websites and services, and across other devices. These parties may collect information directly from a browser or device when an individual visits our Services through cookies or other data collection technologies. This information is used to provide and inform targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.   • Business Partners: From time to time, we may share personal data with our business partners, including parking service providers and other users on our site, or we may allow our business partners to collect your personal information. Our business partners will use your information for their own business and commercial purposes, including sending you any information about their products or services that may be of interest to you.
  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  • Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement:
    • in connection with the establishment, exercise, or defense of legal claims;
    • to comply with laws or to respond to lawful requests and legal process;
    • to protect our rights and property and the rights and property of others, including to enforce our agreements and policies;
    • to detect, suppress, or prevent fraud;
    • to protect the health and safety of us and others, or
    • as otherwise required by applicable law.
  • With Your Consent: We may disclose personal information about an individual to certain other third parties or publicly with their consent or direction. For example, with an individual's consent or direction we may post their testimonial on our Sites or service-related publications.

  1. Third-Party Data Collection and Online Advertising
  2. We may participate in interest-based advertising and use third-party advertising companies to serve you targeted advertisements based on your browsing history. We permit third-party online advertising networks, social media companies, and other third-party services to collect information about your use of our online services over time so that they may play or display ads on our Services, on other websites or services you may use, and on other devices, you may use. Typically, though not always, the information used for interest-based advertising is collected through tracking technologies, such as cookies, web beacons, embedded scripts, location-identifying technologies, and similar technology, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the Sites, AdID, precise geolocation, and other information.

    We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help identify you across devices. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research. We may also use services provided by third parties (such as social media platforms) to serve targeted ads to you and others on such platforms. We may do this by providing a hashed version of your email address or other information to the platform provider.

    We may engage in the following: 

    • Social Media Widgets and Advertising. Our Services may include social media features, such as the Facebook "Like" button, Pinterest, Instagram, Twitter or other widgets. These social media companies may recognize you and collect information about your visit to our Services, and they may set a cookie or employ other tracking technologies. Your interactions with those features are governed by the privacy policies of those companies.
    • Social Media Platforms. We may display targeted advertising to you through social media platforms, such as Facebook, Twitter, Instagram, LinkedIn, and other social media forums. These companies have interest-based advertising programs that allow us to direct advertisements to users who have shown interest in our services while those users are on the social media platform or to groups of other users who share similar traits, such as likely commercial interests and demographics. We may share a unique identifier, such as a user ID or hashed email address, with these platform providers, or they may collect information from our website visitors through a first-party pixel in order to direct targeted advertising to you or to a custom audience on the social media platform. These advertisements are governed by the privacy policies of the social media companies that provide them. If you do not want to receive targeted ads on your social networks, you may be able to adjust your advertising preferences through your settings on those networks.
    • Third-Party Partners. We work with a variety of third-party partners to provide advertising services. For example, we use Google Analytics to recognize you and link the devices you use when you visit our Services on your browser or mobile device, log in to your account on our Services, or otherwise engage with us. We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Services and to tailor our advertisements and content to you.       We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to the Services.     Please note that when you opt out of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our online services. It means that the online ads that you do see from DAA program participants should not be based on your interests. We are not responsible for the effectiveness of, or compliance with, any third parties' opt-out options or programs or the accuracy of their statements regarding their programs. In addition, third parties may still use cookies to collect information about your use of our online services, including for analytics and fraud prevention, as well as any other purpose permitted under the DAA's Principles.

    • Access to Your Device Information.You may control the Services' access to your device information through the "Settings" on your device. For instance, you can withdraw permission for the Services to access your network devices and geolocation and to integrate with your other applications.
    • Email Communications Preferences.You can stop receiving promotional email communications from us by clicking on the "unsubscribe" link provided in such communications.     Before processing your request, we will need to verify your identity and confirm you are a resident of a state that offers the requested right(s).     Submitting Authorized Agent Requests
